Vacation Rental Agreement — Yellowstone Adventures
This Vacation Rental Agreement ("Agreement") is between 4 Seasons Management ("Owner," "Host") and the Guest named above ("Guest"). By checking the box below and submitting payment, Guest agrees to be bound by the terms below.
1. Occupancy & Use. Maximum occupancy is 16 guests. The property is for residential lodging only — no commercial use, parties, weddings, or events exceeding maximum occupancy. Only registered guests disclosed at booking may occupy the property; Guest is responsible for the conduct of all occupants and visitors. The primary guest must be at least 25 years old and present for the stay.
2. Check-In/Check-Out. Check-in is 4:00 PM, check-out is 10:00 AM. Door codes and WiFi credentials are confidential and reset after each stay. Late check-out without prior approval may incur an additional night's charge.
3. Payment. Full payment is due at booking. No refunds for early departure or unused nights except as stated in the cancellation policy below.
4. Cancellation. 30+ days before check-in: full refund minus a processing fee. 14–29 days before check-in: 50% refund. Fewer than 14 days before check-in: non-refundable. No-shows are treated as cancellations.
5. Security Deposit & Damage. Guest authorizes Owner to charge the card on file for damage, excess cleaning, smoking violations, or unauthorized pets discovered after checkout, up to and potentially exceeding the standard cleaning fee. Owner will provide an itemized accounting of any such charges. Smoking/vaping anywhere on the property results in a minimum $500 remediation fee.
6. House Rules. No smoking/vaping. Quiet hours 10 PM–8 AM. Pets only if approved in writing in advance ($250 fee per unauthorized pet). No firearms, fireworks, or unauthorized off-road vehicle use. Guest must secure trash per local wildlife guidance. Game room equipment must be used as intended and treated with care.
7. Wildlife & Natural Hazards. The property is near Yellowstone National Park and may be visited by bears, moose, elk, and other wildlife. Guest acknowledges risks related to wildlife, winter road conditions, and rustic terrain, and assumes responsibility for assessing conditions before and during travel.
8. Assumption of Risk & Liability. Use of the property and amenities — including the hot tub, game room, decks, and grounds — carries inherent risk of injury. Hot tub use is not recommended for pregnant individuals, young children without adult supervision, or those with heart conditions; children must be supervised at all times. To the fullest extent permitted by law, Owner is not liable for injury, loss, or damage except to the extent caused by Owner's gross negligence or willful misconduct. Owner is not responsible for loss or theft of personal belongings. Guest agrees to indemnify and hold Owner harmless from claims arising from Guest's or Guest's occupants'/visitors' use of the property, except where caused by Owner's gross negligence or willful misconduct. Travel insurance is recommended.
9. Property Condition & Access. The property is rented as-is. Owner may enter without notice in an emergency, and with reasonable notice for repairs. WiFi and similar amenities are provided as a courtesy and not guaranteed uninterrupted.
10. No Subletting. Guest may not sublet, re-rent, or list the property/stay on any third-party platform.
11. Termination for Breach. Owner may terminate this Agreement without refund if Guest violates occupancy limits, hosts unauthorized events, engages in illegal activity, causes a safety hazard, or otherwise materially breaches this Agreement. Guest remains liable for the full rental amount and any damages.
12. Governing Law. This Agreement is governed by the laws of the State of Idaho. Any dispute will be resolved in the courts of the county where the property is located. The prevailing party in any enforcement action is entitled to reasonable attorneys' fees.
13. Electronic Signature. Checking the agreement box and typing your name below, followed by payment, constitutes a legally binding electronic signature equivalent to a handwritten signature.
